RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01329 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be updated to reflect the award of the Air Force Basic Military Training Ribbon. APPLICANT CONTENDS THAT: He was an instructor pilot between 1957 and 1962; however, there was no instructor ribbon while he served. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 11 Sep 48. On 30 Sep 68, the applicant was furnished an Honorable discharge, and was credited with 20 years and 20 days of active service. The applicant’s DD Form 214 reflects he was awarded the following Air Force Medals and/or Ribbons: - Air Force Commendation Medal with two oak leaf clusters - National Defense Service Medal with one bronze star - Army of Occupation Medal - Good Conduct Medal - Air Force Outstanding Unit Award - Armed Forces Reserve Medal - Small Arms Expert Marksmanship Ribbon - Vietnam Service Medal with one Bronze Star - Republic of Vietnam Campaign Medal - Air Force Longevity Service Award with three oak leaf clusters The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The Air Force Basic Military Training Instructor Ribbon was authorized for instructors at Basic Military Training and Officer Training School. Instructors of pilots do not meet the criteria of this award. They were able to determine that the below Air Force Medals and/or Ribbons should have been awarded during the applicant’s service from 11 Sep 48 to 30 Sep 68 and were not reflected in his records. Upon final board decision, administrative correction of the applicant’s official military personnel record will be completed by AFPC/DPSOR: - Korean Defense Service Medal - Republic of Vietnam Gallantry Cross with Palm A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant contends he was never assigned to a unit that met the eligible criteria for the award of the Republic of Vietnam Gallantry Cross with Palm (Exhibit E). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission, to include his rebuttal comments, in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
